# Polymarket's 2022 settlement was a standing condition, not a clean slate.

**In one line:** A settlement is a standing condition, not a clean slate.

**WAKENEX concept:** [Match the feedback to the question](https://wakenex.com/concepts/match-the-feedback-to-the-question/)

![A bright, sunlit wooden desk under clean daylight. A thick official case folder lies bound shut with crossed cord and a wax knot, every surface blank, made to look sealed and put away. But along its bound edge it has sprung open a crack, and a vivid warm-orange glow pours out from inside like embers reigniting, with sparks and a thin ribbon of light curling up above it. The sealed folder is still burning back to life from within. The glow carries one bold warm-orange accent against the cool teal surroundings; the left of the frame is an empty pale-teal wall.](https://wakenex.com/assets/notes/treating-a-2022-settlement-as-a-clean-slate-is-the-mistake/cover-1600.jpg?v=a36e606670)

On Oct 27, Reuters reported the CFTC has revived its investigation into whether the prediction-market exchange actually kept U.S. users off its offshore platform, the exact promise it made to settle in 2022 and the inquiry regulators said they had closed in July 2025.

A settlement is never a pardon. It is a standing condition: stay out of the U.S., and keep proving it. The agency is examining the current controls, not the old conduct: how Polymarket verifies where customers sit, whether it advertises to Americans, what its own social accounts push. Those are present-tense questions, and 'we settled years ago' cannot answer them.

An April 2026 insider-trading charge against a U.S. soldier who traded on the platform, which a judge has refused to dismiss, is exactly the kind of fact that turns a closed file back into an open one.

For anyone pricing platform or corporate risk: 'settled' and 'probe closed' describe a case file, not a behavior. A dormant liability reprices the moment the conduct that created it quietly continues.

This read is wrong if Polymarket can show its geofencing blocked U.S. access at scale after 2022. Then the reopened probe is noise.

Research, not investment advice.
