# Reserved blockspace with a zero penalty is a promise, not a guarantee.

**In one line:** Reserved blockspace with a zero penalty is a promise, not a guarantee.

![A bright editorial illustration: a businessperson seen from behind holds up a glowing golden reservation ticket toward a premium priority gate that leads into a vast sunny hall of glowing reserved block-slots; but the gate's barrier is only a tearing paper ribbon and a large brass padlock hangs on it wide open, guarding nothing. White headline reads 'A Reservation Backed by Zero Penalty'; a Chinese line beneath reads 没有违约金撑腰的预订.](https://wakenex.com/assets/notes/reserved-blockspace-with-a-zero-penalty-is-a-promise/cover-1600.jpg?v=c91ee5f30d)

That is what ETHGas is now selling Wall Street on Ethereum.

The pitch, reported by CoinDesk on November 3, is clean: banks reserve space in upcoming Ethereum blocks, pick which validators process them, screen counterparties for sanctions, and get a validator-signed preconfirmation in about 50 milliseconds, all while settling on the public chain. ether.fi has committed roughly $3 billion of ether over three years; about $800 million in blockspace is already spoken for. It sounds like guaranteed inclusion.

Then read what the founder said. Kevin Lepsoe: the compensation amount is set to 0. A validator that signs your preconfirmation and then drops it pays nothing. So you are not buying a guarantee. You are buying a signed promise, backed by reputation, and you keep the entire downside when it breaks.

That matters most exactly when it is supposed to help. In a calm block, promises hold and no one notices the missing penalty. In the congested, volatile block you reserved space for, a validator has the strongest reason to renege and the smallest cost for doing it. Certainty is being priced; the non-delivery risk is handed to the buyer.

This breaks if ETHGas puts a real, enforceable penalty on a missed preconfirmation and it holds through a congested block. Until that number stops being zero, institutional blockspace is priority you pay for but cannot enforce.

Research, not investment advice.
